What the bill would require

The Environmental Protection Agency (EPA)
, working with the Department of Energy, the National Institute of Standards and Technology (NIST), the White House science office, the Interior Department, and the Federal Energy Regulatory Commission, would have to complete a broad study within 1 year.

The study would look at the
full lifecycle
of AI, including:

the electricity and water used by AI systems and data centers,

air and water pollution,
-
noise and light impacts,
-
greenhouse gas emissions,
-
electronic waste from hardware,
-
effects of building and operating energy infrastructure, and
-
land use, including possible effects on scenic, historic, cultural, and national park areas.

The study would also examine how choices like model design, hardware, location, energy source, backup power, cooling systems, and leasing arrangements affect those impacts.

The EPA would have to hold public hearings in each EPA region and consider public comments.
AI environmental reporting system

The bill would require the EPA to create a
reporting system
for entities that operate AI data centers.

Covered operators would have to submit
annual reports
describing the environmental impacts of their AI data centers.

The reporting rules would cover topics such as:

electricity use and power sources,
-
power usage effectiveness and energy efficiency,
-
water use,
-
air and water pollution,
-
electronic waste,
-
noise and light pollution, and
-
other positive and negative impacts of AI use.

The EPA would be allowed to require enough detail to check whether reports are accurate and complete.

Most of the reported information would be made publicly available online, except for information protected from disclosure under existing law.

If a covered entity does not comply, the EPA would first seek corrective action and could later impose an administrative penalty based on the size of the facilities and how long the company stayed out of compliance.
NIST stakeholder consortium

NIST would have to convene a consortium of stakeholders, including representatives from Indian Tribes, local governments, academia, civil society, and industry.

The consortium would work on methods, standards, and measurement tools for tracking the environmental impacts of AI.

Its goals would include making reporting more consistent, developing or cataloging open-source tools, and recommending ways to reduce negative impacts and better use AI for environmental purposes.

The consortium would need equal representation across stakeholder groups, with at least 3 representatives each from geographically distinct Tribal communities and from cities or counties where AI data centers are located.
Report back to Congress

After the consortium is convened, and within 2 years after the EPA finalizes the reporting requirements, EPA, DOE, and NIST would have to send Congress a joint report.

That report would summarize the consortium’s findings, describe the information collected through the reporting system, and give recommendations for legislative or administrative action.

It would also identify AI use cases that appear to have net environmental benefits.
