This bill would expand and clarify legal protections for firearms manufacturers, sellers, and related trade groups under the Protection of Lawful Commerce in Arms Act.

What it would change

  • Would require courts to dismiss certain pending lawsuits immediately if they are considered “qualified civil liability actions” under the law.
  • Would broaden and define key terms such as:
    • who counts as being “engaged in the business” of selling firearms or related products,
    • what counts as a “qualified product,” which includes firearms, ammunition, parts, accessories, magazines, clips, and optical devices,
    • who counts as a “seller,” including importers, dealers, ammunition sellers, and businesses selling other covered firearm-related products, as well as their owners and employees.
  • Would define “proximate cause” more narrowly to mean that the plaintiff was directly injured by the defendant’s unlawful conduct.
  • Would say that many lawsuits connected to the criminal or unlawful misuse, alteration, or modification of a firearm or related product are barred , including claims based on tort, contract, statutes, or other legal theories.
  • Would keep some exceptions to immunity , including:
    • claims against a person convicted of unlawful firearm transfer in certain circumstances,
    • claims for negligent entrustment or negligence per se,
    • claims where a manufacturer or seller knowingly violated certain federal firearm, tax, export, or similar state laws and that violation directly caused the harm,
    • claims for breach of contract or warranty,
    • claims for death, injury, or property damage caused directly by a product defect when the product was being used lawfully or in a reasonably foreseeable way,
    • civil actions by the Attorney General to enforce federal firearm or tax laws.
  • Would limit lawsuits brought by foreign governments against firearms manufacturers, sellers, or trade associations for harm linked to criminal misuse or alteration of qualified products.
  • Would set special court procedures for these cases:
    • defendants could move cases from state court to federal court,
    • plaintiffs would have to plead detailed facts to fit within an exception,
    • defendants could take immediate appeals if dismissal is denied,
    • successful defendants would be entitled to attorney’s fees and court costs.
  • Would preempt state and local laws that impose liability on covered manufacturers, sellers, or trade associations in ways the bill covers.
